PROTECTING TRANS NEW JERSEYANS

The Reproductive Freedom and Health Equity bill package, which was introduced in the summer of 2024, contains nine bills that would build on New Jersey’s existing healthcare protections.

Gender-affirming care is best-practice, medically necessary healthcare supported by all major medical associations. It improves mental health and quality of life, and is often lifesaving for those who can access it.

New Jersey has many protections in place, such as Gov. Murphy’s executive order making New Jersey a safe haven for gender-affirming healthcare—but many of them are not codified in law, and could be overturned after this year’s gubernatorial election or upon a single court decision.

Trans people are disproportionately likely to face barriers to healthcare.

It’s crucial that protecting access to gender-affirming care be included in this bill package.

THE THREATS

The current presidential administration and an upcoming Supreme Court case are the latest threats to medically necessary, lifesaving gender-affirming healthcare for trans people.

A January 28 Trump executive order directed federal agencies to illegally defund healthcare providers who provide gender-affirming medical treatments to anyone under 19.

These illegal, unethical policies aren’t even in force yet. But they’ve already had a chilling effect, causing providers to cancel appointments with trans patients.

This summer, the Supreme Court will issue a ruling on U.S. v. Skrmetti, a landmark case challenging Tennessee’s ban on gender-affirming healthcare that will have a nationwide impact.

Having protections in New Jersey is also crucial for the 39 percent of trans youth who live in states with gender-affirming care bans and may want to access care here.

The Reproductive Freedom and Health Equity bill package is comprised of nine bills.

The three bills listed below specifically have the potential to protect gender-affirming care for trans people in New Jersey.


Reproductive Care Coverage and Provider Protection (A4601/S3452)
Passed Senate

  • Requires health insurance and Medicaid coverage for family planning and reproductive healthcare services
  • Prohibits adverse actions by medical malpractice insurers in relation to performance of legally protected healthcare services, including reproductive healthcare and gender-affirming healthcare


Right to Legally Protected Healthcare (A4656/S3491)
Introduced

  • Secures protections for patients and providers accessing and providing legally protected healthcare, including reproductive healthcare and gender-affirming healthcare
  • Establishes right of New Jerseyans and people in New Jersey from other states to legally protected healthcare services that are restricted in other states


Data Privacy (A4658/S3493)
Passed Senate Health, Human Services and Senior Citizens Committee

  • Requires affirmative written consent for certain entities to disclose medical information regarding reproductive healthcare services, with limited exceptions, unless disclosure is necessary to provide those services.
  • This bill has amendments pending that would include medical information about infertility and gender-affirming healthcare.
